I believe it would depend upon a number of factors. What was the crime committed? Who was harmed by it? What choice would be more just, or perceived as more just? Would pardoning that person give people faith that true justice will be served and thus inspire them to better themselves, or will it suggest to people that the law in general can be thwarted and thus encourage them to ignore it? Is it possible that the law itself is unjust and ought to be altered?

Each individual circumstance is different, after all, and it's impossible to judge but when presented with it.
